Project Proposal Terms and Conditions

Scope of Work

The proposal covers the fabrication, delivery, and installation of vinyl graphics as described in the project details.

Any changes to the agreed-upon scope, including design modifications or additional installations, will require a change order and may result in additional costs.

Payment Terms

A deposit of 50% is required to initiate the project.

Payments are accepted via bank transfer, credit card, debit card, check, Zelle transfer, Venmo transfer.

The remaining 50% balance is due 7 days upon completion of installation.

Timeline

We are committed to meeting the project completion timelines to the best of our ability. However, delays caused by unforeseen circumstances (e.g., weather, supply chain issues) may result in adjustments.

Design and Approval

The client is responsible for providing final approval of all designs before production and installation. Any changes after production/installation begins may result in additional charges.

Site Preparation

The client is responsible for ensuring that the installation site is clean, accessible, and free of obstructions. Additional charges may apply for site preparation or delays caused by inaccessible conditions.

Warranty

Vinyl materials and installation workmanship are warranted for 30 days against defects under normal usage conditions.

Warranty does not cover damages caused by misuse, vandalism, or exposure to extreme environmental conditions.

Liability

Kabata Werks LLC is not liable for damages resulting from improper use, environmental factors, or pre-existing conditions at the installation site.

Cancellations and Refunds

Cancellation fees will apply if the client terminates the project after work has begun. Refunds will be adjusted based on the progress of the project and expenses incurred.

Ownership of Materials

All goods remain the property of Kabata Werks LLC until full payment is received. Failure to pay will result in the repossession of installed goods.

Intellectual Property

All design files, concepts, and templates created by Kabata Werks LLC remain the intellectual property of the company unless otherwise agreed in writing.

Validity of Proposal

The project proposal you receive is valid for 30 days from the date of issue. Pricing, availability, and timelines may be subject to change after this period.

Force Majeure

Kabata Werks LLC shall not be held responsible for delays or inability to complete the project due to events beyond its control, including natural disasters, strikes, or government restrictions.

Dispute Resolution

Any disputes arising from this agreement will be resolved through mediation as per the laws of New York City.
